1. Agreement to Terms

By accessing or using the services provided by TheBigSparrow ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services

TheBigSparrow provides web design, brand identity, and motion graphics services. Our services include but are not limited to:

• Website design and development
• Brand identity creation and strategy
• Motion graphics and animation
• UI/UX design
• Conversion rate optimization

3. Project Engagement

Proposals and Agreements

All projects begin with a detailed proposal outlining scope, timeline, and pricing. Work commences only after written acceptance of the proposal and receipt of the agreed-upon deposit.

Payment Terms

Payment terms are specified in individual project proposals. Standard terms require a 50% deposit to commence work, with the remaining balance due upon project completion.

4. Intellectual Property

Client Materials

You retain ownership of all materials you provide to us, including logos, images, and content.

Deliverables

Upon full payment, you receive ownership of all final deliverables. We retain the right to display completed work in our portfolio unless otherwise agreed in writing.

5. Revisions and Feedback

Each project includes a specified number of revision rounds as outlined in the project proposal. Additional revisions beyond the agreed scope may incur additional charges.

6. Project Timeline

Timelines are estimates based on the agreed scope. Delays in providing feedback, content, or approvals may extend the project timeline. We are not responsible for delays caused by factors outside our control.

7. Cancellation and Refunds

If you wish to cancel a project:

• Before work begins: Full refund of deposit minus 10% administrative fee
• After work begins: Payment due for work completed to date
• After 50% completion: No refund; full payment required for work completed

8. Limitation of Liability

TheBigSparrow shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific project in question.

9. Confidentiality

We agree to keep confidential any proprietary information shared during our engagement. This obligation survives the termination of our business relationship.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
